YACHT CLUB DE FRANCE 2011

Cannes - Saint Tropez

The legal text for this Notice of Race is the text in French from which this translation is issued.

I - Organisation
The "Coupe d'Automne du Yacht Club de France" from Cannes to Saint-Tropez is a race organised by "the Société Nautique de Saint-Tropez" with the technical assistance of the Yacht Club de Cannes for the start in Cannes.

II - Date
The start of the race will be on Sunday 25th September 2011.

Competitors shall be at the Race Committee disposal at 11.00 am in the bay of Cannes.

A mandatory skippers' briefing will be held at 09.00 am the day of the start. The location will be posted on the official notice board.

III - Rules
The race is governed by :
- The International Sailing Rules 2009-2012 (RCV) and the prescriptions of the FFV,
- The measurement rules and Class rules for the Vintage Yachts and Traditional Classic Yachts published by the Mediterranean International Committee (CIM),
- The IRC rules for the "Spirit of tradition" yachts
- The Class rules for each class,
- The present Notice of Race and its possible amendments,
- The Sailing Instructions, appendixes and possible amendments, given to the competitors before the start.

The skippers agree to respect article n°4 of the French law of 3rd May 1995 (and specially to conform with the navigation category in accordance with their boat's equipment :

"Article 4 : The skipper is the captain of his boat in terms of the maritime law : he has the entire responsibility of the boat and his crew. He has to make sure that all the required equipment is in good condition, that the crew knows where it is located and how to maneuver it and how to use it. It is his sole responsibility not to start the race or to stop in a calm bay if the circumstances become dangerous for the boat and his crew."

Regarding the safety equipment, boats must be equipped in conformity with the law of their countries for the race. Inspections may be done before the start in Cannes and/or at the arrival in Saint-Tropez.


IV - Advertising
Yachts must be in accordance with the rule n° 80 of the RCV; Advertising is not allowed.

V - Invited Classes
Vintage Yachts, Traditional Classic Yachts, Spirit of Tradition Yachts, and Metric Classes (12 m JI, 8 m JI, 6m JI). If more than 3 Tofinou 9,5m boats are registered , they will race in One Design Class.

Only boats registered at the "Régates Royales" in Cannes or the "Voiles de Saint-Tropez" in Saint-Tropez are allowed to participate.

VI -Registrations
The entries will be registered in Cannes at the "Régates Royales" Race Headquarter on the following dates and hours:
- on September Thursday 22th from 9 am to 11am and from 3pm to 7 pm
- on September Friday 23th from 9 am to 11am and from 3pm to 7 pm
- on September Saturday 24th from 9 am to 11am and from 2pm to 8 pm, last time.

No entry will be accepted after 8pm on the Saturday 24th of September.

Entry will be considered as definitive when entry fee is paid and the skipper has given a copy of the measurement certificate 2011, a written confirmation of the third part insurance policy valid for the race and the entry form with the completed crew list.

Each skipper and crew living in France shall present to the Race headquarter his French sailing 2011 license with a medical stamp or with a written confirmation from a medical doctor of his aptitude to sailing competition with the crew list.

Foreigners shall be in accordance with their MNA and justify of a valide third party insurance up to Euros 1 500 000 per person.

VII- Entry Fees
To be paid to the Race Headquarter at time of registration :
- Boats rated CIM with hull length (LT) or boats rated IRC with LOA less than 15 meters : 50 euros
- Boats rated CIM with hull length (LT) or boats rated IRC with LOA equal to or over 15 meters : 100 euros

For a best identification of the boat, 2 numbered dodgers (for boats without Sail number) and 1 colored pennant will be given to skippers in Cannes in exchange of a deposit of 100 €.
This deposit will be given back when the skipper will return the dodgers after arrival at the Voiles de Saint-Tropez Headquarter before 8:30 pm.
Dodgers and pennant will be given at the skipper briefing on Saturday morning before the start, in exchange of the crew list if it could not be completed earlier.

Any boat with improper identification marks will be disqualified.

VIII - Berthing in Harbours
Yachts registered at the Régates royales will benefit of a free berthing in Cannes the night before the race. Yachts not registered at the Régates royales must contact the Cannes harbor authority to obtain a berth for the night before the race. Yachts not registered at the Voiles de Saint-Tropez will not have access in the harbor because of lack of space

IX - Results

he results will be established as followed :

1- Corrected time : time on distance for boats rated CIM and for "the Spirit of tradition' yachts. For "Spirit of Traditions" yachts, an APM calculated according to their IRC certificate will be applied.

2- Elapsed time: all metric rated yachts if they are at least 3 boats, and the "Tofinou 9,5m" if they are more than 3 boats.

X - Prizes
The prizes of the Yacht Club de France will be given as followed :

- to the three firsts on corrected time of:
- the Vintage Gaff Rigged Yachts
- the Vintage Marconi Rigged Yachts with hull length (LT) over 16,5m
- the Vintage Marconi Rigged Yachts with hull length (LT) under or equal to 16,5m
- the Classic Yachts
- the Spirit of Tradition Yachts if they are at least 3 boats
- to the first in elapsed time of :
- each metric class having at least 3 boats
- the "Tofinou 9,5m" if they are more than 3 boats

Classes may be merged in accordance with CIM Rule 17.

XI - Time limit
The time limit to finish the race is 6:30 pm on Sunday 25th of September 2011.
A boat which has not crossed the finishing line before this time limit will be classified as DNF (RRS 35 modification).

XII - Course
In accordance with CIM rule 18, the race is a B type race.

The detailed course and a procedure to reduce the course will be given in the Sailing Instructions.

XIII - Jury
Protests will be judged by the International Jury of the "Voiles de Saint-Tropez".

XIV - Responsability of Organisers, Partners and Participants
The race organiser and their partners' responsibility is limited to guarantee the fairpaly and the respect of the rules of the event.
Any other responsibility assumed by the organiser can only be explicit and contractual.
In particular: The watch, and especially the radio watch, which the organiser may keep, must be considered by competitors as optional and random and should in no way be considered to be an additional safety measure on which they can count.
The race "Coupe d'Automne du Yacht Club de France" is a sporting event. Regardless of the links between the owner of the yacht and the skipper, the registered skipper will be considered as the sole valid representative by the Race organization.

Owners or skippers of the yachts are personally responsible for all accidents or materials and/or human damages that may occur to themselves, the crew, the yachts or a third party or to the property of a third party. It is their responsibility to contract the appropriate insurance to cover all the above risks and responsibilities.
In particular, the skipper is responsible before the race organiser of the subscription of all necessary insurance policies to cover its civil liabilities up to a minimum amount of 1.5 millions Euros. He will have to prove evidence of this insurance in remitting to the organiser an insurance certificate from its insurance company when registering at the Coupe d’Automne du Yacht Club de France. Failing to do this, the skipper will not be allowed to take part in the race and any entry fee already paid will be not be reimbursed.

The lack of third party insurance will in no way imply or create any responsibility for the organizers and/or their partners.
